These Terms apply to individual users ("Students") and organizations ("Institutions"), with distinct responsibilities outlined.

1.3. No Minors

The Platform is not intended for individuals under 18 years of age. By accessing or using the Platform, you represent that you are at least 18 years old.

2. Platform Use

2.1.

The Platform is for educational purposes only and does not replace professional medical advice, diagnosis, or treatment.

2.2.

Users must not share login credentials, perform unlawful activities, or reverse-engineer the Platform.

2.3. Fair Use Policy

Usage is limited to 1 hour per day per user. This may be increased or decreased at the discretion of MedMock.com. Of note, this is an emerging technology and prices are likely to decrease and limits therefore increase. Excessive or automated use is prohibited.

2.4. Not a Medical Device

The Platform is categorically not a medical device and is not intended for clinical or medical use. All functionality is purely for educational simulations.

2.5. Account Suspension for Shared Credentials

MedMock.com reserves the right to cancel or suspend a user's access if there is reasonable suspicion that login credentials have been shared or otherwise misused.

3. Institutional Use

3.1.

Institutions are responsible for ensuring compliance with these Terms by all users under their license.

3.2.

Institutions must not sublicense, resell, or redistribute access to the Platform.

4. No Warranties and Limitation of Liability

4.1.

The Platform is provided "as is" and "as available," with no guarantees on accuracy, availability, or performance.

4.2. Limitation of Liability

To the fullest extent permitted by law, MedMock.com shall not be liable for any indirect, incidental, special, consequential, or punitive damages, nor any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from:

  • (a) your access to or use of or inability to access or use the Platform;
  • (b) any conduct or content of any third party on the Platform; or
  • (c) unauthorized access, use, or alteration of your transmissions or content.

4.3. Liability Disclaimer

MedMock.com assumes no responsibility for decisions based on use of the Platform. Any reliance on the Platform's content or functionality is at your own risk.

5. Payments and Refunds

5.1.

Payments must be made in full for subscriptions or institutional agreements within 14 working days of agreement.

5.2.

No refunds once the service is accessed. Refunds may be granted for technical issues at the sole discretion of MedMock.com.

6. Performance Variability

6.1.

Platform performance may be affected by concurrent user volume or network/server conditions and the device used.

7. Data Ownership and Intellectual Property

7.1.

All content and AI models on the Platform are the intellectual property of MedMock.com. This includes, but is not limited to, text, graphics, logos, and software code.

7.2.

Interaction logs and transcripts are owned by MedMock.com and may be used for research or service improvement purposes.

8. Termination and Suspension

8.1.

Accounts may be suspended or terminated for breach of these Terms or fraudulent activity.

8.2. No Right to Appeal

If your account is suspended or terminated, there is no right to appeal. MedMock.com's determination is final.

10. Cookies

10.1.

The Platform uses cookies for user sessions, performance optimization, and analytics.

11. Governing Law and Dispute Resolution

These Terms are governed by the laws of England and Wales.

11.2.

Disputes will be resolved under the London Arbitration Centre rules.

11.3. Jurisdictional Nuances (U.S. Users)

Users located in the United States must comply with all relevant federal and state laws. In any instance where U.S. law mandates different or additional requirements beyond these Terms, such requirements shall take precedence to the extent necessary to ensure compliance with U.S. law.

You agree to indemnify, defend, and hold harmless MedMock.com and its affiliates, officers, directors, employees, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or in connection with:

  • (b) your misuse of the Platform; or
  • (c) your violation of any applicable law or the rights of a third party.

15.1.

The Platform may integrate or utilize services provided by third parties such as Google, ChatGPT, Stripe, or others. Your use of these services is subject to each respective provider's terms and policies. MedMock.com does not control and is not responsible for the content, performance, or data handling practices of such third-party services.

16. Export Controls and Sanctions Compliance

16.1.

You agree to comply with all applicable export and re-export control laws and regulations, including but not limited to those administered by relevant government agencies. You represent that you are not located in, under the control of, or a national or resident of any country to which the export of the Platform or related information would be prohibited by applicable law.

17. Probity

17.1.

Depending on your institution's requirements, the Platform may be used as part of workplace-based assessments or other educational metrics. Any misuse, falsification, or dishonest representation of your activity or results may be considered a probity issue. MedMock.com reserves the right to cooperate with relevant institutions or regulatory bodies in investigating such misconduct.
